Roy Rappaport argues that religion is central to the continuing evolution of life, although it has been been displaced from its original position of intellectual authority by the rise of modern science. L’opera, ispirata dalla novella del D.lgs. 28/2015 tratta delle modifiche introdotte, nell’ordinamento penale, in materia di non punibilità nei casi di particolare tenuità del fatto. In particolare, l’istituto viene analizzato sia sotto il profilo sostanziale, secondo quanto previsto dall’art. 131 bis c.p. (“Esclusione della punibilità per particolare tenuità del fatto”), che sotto il profilo processuale, attraverso l’esame della modifica dell’art. 411 c.p.p. (“Altri casi di archiviazione”) al comma 1 e l’inserimento del comma 1 bis, dell’art. 469, al quale è stato aggiunto il comma 1 bis (“Proscioglimento prima del dibattimento”) con la conseguente possibilità di emissione di una sentenza di non doversi procedere ed, infine, dell’art. 651 bis c.p.p. che affronta la tematica della “Efficacia della sentenza di proscioglimento per particolare tenuità del fatto nel giudizio civile o amministrativo”. In aggiunta, poi, all’analisi delle norme codicistiche, al fine di dare altresì un taglio pratico e concreto al lavoro, si è deciso di dare contezza anche degli orientamenti giurisprudenziali che rapidamente si stanno formando in materia.
